Terms of Use

The booking Platform is an online service provided by AllTrain Ltd. It is accessed through the link book.alltrain.co.nz. This is also known as "the Platform." Please read these terms and conditions carefully. By using the Platform you are a "Platform User" and agree to these terms of use. Platform Users include people who manage courses, deliver training, book themselves or others into courses and use the Platform in any way. If you choose not to be bound by the terms and conditions, you must not use this Platform.

Client Requirements

  1. Advise AllTrain Ltd of any onsite Health and Safety induction needs, COVID requirements and emergency procedures prior to the start of training
  2. Provide suitable training room, air-conditioning/ heating, bathroom access, power outlets, tables, chairs, whiteboard, projector screen/ white wall or TV (HDMI compatible) and tea/ coffee facilities for the duration of the course
  3. Provide fit for purpose machinery and equipment.
  4. Supply trainees with appropriate PPE for practical assessment
  5. Practical assessment area must be isolated from and not impede any site operations
  6. Prior to the start of training, provide to AllTrain Ltd any site/ company SOP’s, Safe Work Systems or Permit requirements
  7. Trainees must be at least 15 years of age at the time of attending training
  8. Trainees must provide a copy of a NZ Passport, NZ Drivers licence as proof of identification.

As an AllTrain Ltd user, course registrant, customer you agree to these Terms and Conditions.

Terms and Conditions and products are subject to change at any time during the terms of this agreement. Any such changes will be notified in writing.

'Service', 'Services' means any service that is provided by AllTrain Limited including but not limited to training courses, assessments, or consultancy

Changes to Terms and Conditions

We reserve the right to update these Terms and Conditions from time to time and if we do so, we will revise the date and revision number of this document.

Cancellations, Rescheduling & Refunds Policy

Cancellation or rescheduling of training courses and booked services must be made in writing to info@alltrain.co.nz. Cancellation fees are based on full course costs and will be incurred on the following basis:

The customer agrees to pay any additional costs incurred by AllTrain Limited, such as travel and accommodation and flights/ferry travel costs that may have been incurred.

AllTrain Limited will not be liable for costs incurred by the customer due to cancellation arising from circumstances beyond our control.

From time to time we may need to reschedule a course or cancel a course due to trainer availability (sickness, bereavement etc), venue availability or low course attendance for example.

Funded Courses.

AllTrain Limited accepts no responsibility for the withdrawal of any funding or subsidies. In the event that funding/subsidies are withdrawn, or the Customer is found not to be eligible for the funding/subsidy, AllTrain Limited will invoice the Customer the full course cost.

AllTrain Limited will endeavour to deliver the course in the first instance with course cancellation a last resort. While we will do our very best to provide a minimum of 48 hours’ notice, from time to time the notice may be as little as 24 hours. We will arrange for an alternative time and date for attendance and where you are not able to attend, a full refund or payment for the course is provided.

Failure to attend training

Failure to attend a course will result in a ’No Show’ attendance status. All ‘No Shows’ will be charged the full course cost.

Late Student Arrival

Within 60 minutes of scheduled start time: Student may remain on course only at the trainer’s discretion. Over 60 minutes of scheduled start time: Student may not attend the course. Should it be necessary for the student to return to complete the course at a later date due to late arrival issues, AllTrain Limited or any contracted trainer reserves the right to pass on any associated costs to the student or their employer.

Course/ Training Schedule

The availability of courses and dates published on the Website are subject to change without notice.

Company Specific Courses

If training is held at the Customer’s premises the Customer agrees to provide all facilities including training room, air-conditioning/ heating, bathroom access, power outlets, tables, chairs, whiteboard, projector screen/ white wall, and tea/ coffee facilities. Facilities for specific courses are as detailed in the confirmation email and are according to the course requirements.

Safety Gear and Personal Protective Equipment (“PPE”)

In accordance with the HSWA 2015, all students are required to comply with any instruction, policy or procedure issued by AllTrain Limited in relation to the use of PPE. This includes, but is not limited to, the wearing of hard hats and safety footwear. Failure to comply may result in a student being removed from the course in the interest of safety. Should it be necessary for the student to return to complete the course at a later date, AllTrain Limited reserves the right to pass on any associated costs to the student or their employer.

Entry Standards

There is a requirement that candidates must have a NCEA level 1, year 11, level of written and oral English or IELTS 5.5, to be eligible to enrol on the courses. Failure to comply with this requirement may result in the candidate being put at an unfair disadvantage. The person responsible for authorising attendance at the course must agree to and sign these terms and conditions of the course prior to acceptance of their candidate(s) onto the course. In the case where the candidate(s) do not meet the English language requirement a reader writer must be supplied, by the candidate or the person responsible for authorising attendance.

Special Requirements

AllTrain Limited must be advised if the student has any special requirements including but not limited to health, literacy and cultural requirements.

Student Progress/Requirement for Completion

Learning objectives are detailed at the beginning of each training module and assessment is conducted throughout the course. A practical assessment may also be conducted in some programmes. Candidates will be required to achieve the required level of competency in all areas of the assessment to be awarded the unit standard(s) and credits. Assessment is conducted in compliance with competency based assessment according to NZQA criteria.

Funded Courses

AllTrain Limited accepts no responsibility for the withdrawal of any funding or subsidies. In the event that funding/subsidies are withdrawn, or the Customer is found not to be eligible for the funding/subsidy, AllTrain Limited will invoice the Customer the full course cost.

Pre-Course / Post-Course Requirements

The Customer accepts full responsibility for failure to abide by any pre-course or post-course requirements. This includes, but is not limited to, completing and returning course paperwork, evidence of competency, Logbooks, attestation forms.

Student Progress/Requirement for Completion

Attestation Forms

Where an Attestation Form is required, the participant will have two weeks from the date of the course to complete and return the form to AllTrain Limited. Failure to return a completed attestation form will prevent the unit standard being processed. This may result in any funding/subsidies being withdrawn and the participant will be invoiced the full non-funded course cost accordingly.

NZQA Framework Registration

AllTrain Limited or it’s associated contractors may process as applicable NZQA unit standards through accredited Private Training Establishments (PTE’s) or Industry Training Organisations (ITO’s) who will upload credits to the NZQA Framework within 4 weeks following course completion based on awarded competency. Additional charges will apply per extra unit/ credit added at the time of booking.

Competency

It is AllTrain Limited ’s or our contracted Accessor’s intention to mark a course participant as Competent “C” or Not Yet Competent “NYC” upon completion of the course. A participant who is marked as C will receive their Certificate (if requested) within four weeks of completing the course. A candidate who is marked as NYC cannot have the unit standard accredited to them and will not receive any certification. The Customer will be advised if a candidate is marked NYC and the reason why. A plan will be developed with the Customer to ensure that the Candidate has all opportunities afforded to achieve competency status.

Payment Terms

Public attendees:

Once you have returned your booking form an invoice will be raised, then Payment can be made using the invoice number as the reference. Payment must be received by AllTrain Limited prior to attending the course unless you have an agreed arrangement. Once payment has been received, we will send you confirmation by email.

Note: All individual clients must pay in full before the course commencement date.

Non account holders:

Are required to pay invoices within 7 days of the date of invoice.

Prices and Additional Fees

The prices published on the Website are subject to change without notice unless you have an agreement with us stating otherwise. Issuing Replacement ‘Certificates of Attendance or Achievement will incur an administration fee of $25.00 Excl GST each and requires payment before the request can be completed. The Customer agrees to pay any additional costs incurred by AllTrain Limited, such as travel and accommodation when local resource is unavailable. These charges will be charged at cost to the Customer and will be advised during the booking process.

Cancellation

The customer agrees to pay any additional costs incurred by AllTrain Limited, such as travel and accommodation and flights/ferry travel costs that may have been incurred.

AllTrain Limited will not be liable for costs incurred by the customer due to cancellation arising from circumstances beyond our control.

Communication

You may occasionally receive e-newsletters and promotional emails from Overwatch Solutions Limited once the booking form has been returned. You can unsubscribe by following a link in any of the emails you receive. Overwatch Solutions Limited will not pass your email on to any 3rd party unless required to do so by law.

TRAINING PROPOSAL ACCEPTANCE

Declaration: By signing and returning the Course Booking Form or making an online booking, the customer acknowledges and agrees to be bound by these Terms and Conditions.

Privacy Policy

All data collected about bookers and students is used for the purposes of delivering the training service. Student data is used enable the course Instructor and AllTrain Ltd administrators to check the identity or each student and assess their eligibility for the course, register qualifications with the relevant authorities and meet the reporting requirements of those authorities, which may include providing gender and ethnicity information.  Where you provide email addresses or phone numbers for bookers or students, these details may also be used to send transnational emails or SMS messages which include pre-course and renewal reminders.  The data collected will not be shared with any third party, except the relevant qualifications' authority. Bookers have the option of opting in or out of other AllTrain Ltd Training Updates.  Those who opt into these updates may unsubsubscribe at any time.

Terms of Platform Use

Termination

AllTrain Ltd may, at its sole discretion, terminate this agreement or restrict your access to the Platform without advance notice or liability, for any reason, including your failure to comply with the terms of use of the Platform. If your account is terminated you must stop using the Platform. In the event of termination for non-compliance with these terms, all rights granted to you will terminate.

Availability

AllTrain Ltd and its providers use reasonable commercial efforts to keep the Platform available 24/7. Exceptions are scheduled maintenance, unscheduled maintenance and Platform outages. We cannot promise that the Platform will always be available and assumes no liability or responsibility for any interruption or its consequences. Book early to avoid being disappointed.

Content

The information on the course pages is provided in good faith and AllTrain Ltd takes all reasonable care to keep the information on the Platform accurate. AllTrain Ltd assumes no liability or responsibility for any errors or omissions. You are responsible for evaluating the accuracy, completeness and usefulness of all content available through the Platform or from a linked Platform. You should not assume any booking on this Platform is complete until you receive a confirmation notice at the end of the booking process or a confirmation email from AllTrain Ltd.

Security Capabilities and Policy for Transmission of Payment Card Details

When you pay by credit card via this site you are passed to an e-commerce gateway provider. You will see the provider name before you enter your credit card details. The provider may be ANZ e-Gate, DPS Payment Express, Paymark, Stripe, Braintree, eWay or PayPal. You will enter your credit card details within the secure environment provided by the e-commerce gateway provider. When the provider makes these available, we may store your cardholder name and a masked version of your card number. At no time do we store or have access to your complete card number or other card details. All providers are compliant with the Payment Card Industry Data Security Standard (PCI DSS). All communication between this site and the payment gateway is encrypted by 128 bit Secure Sockets Layer (SSL) technology.

Credit Card Transactions

If you are the cardholder, and you dispute any charge on your credit or debit card related to any course, service or product booked through this Site you agree to notify The Site Owner within 24 hours of the scheduled course start time. You agree that The Site Owner will have authority fully equal to that our suppliers in collecting amounts owed for bookings made through this Site from your bank/credit card company or through courts/collection agencies.

The information contained within this Platform including graphics and logos are the copyright of AllTrain Ltd. All programming scripts are copyright of Booking Rooster Ltd who developed The Platform. All trademarks on this Platform are primarily the intellectual property of AllTrain Ltd. Any other trademarks on this Platform are trademarks of their respective owner. Nothing contained on this Platform should be construed as granting any license or right of use of any trademark or copyright displayed on the Platform without the express written consent of AllTrain Ltd, or the third party owner of Intellectual Property.

AllTrain Ltd, Booking Rooster Ltd and their subcontractors will not be held liable for the following events or their consequences:

Indemnity

You shall defend and indemnify AllTrain Ltd, Booking Rooster Ltd and any third party providers and distributors and their officers, directors, employees and agents from and against any claim, cause of action or demand, including without limitation reasonable legal and accounting fees, brought by or on your behalf in excess of the liability described herein in any action filed or commenced by any third party against AllTrain Ltd as a result of

General

If any of our terms are held to be unenforceable, it is agreed that the remainder of the terms will remain in full force and effect. This agreement is governed by the laws of New Zealand, and you irrevocably submit to the exclusive jurisdiction of the courts of New Zealand.
